On Monday, January 25th, the City of Lincoln Councilās Executive approved the implementation of an Article 4 Direction. This measure grants the Council greater control over the location and concentration of Houses in Multiple Occupation (HMOs) within the city.
Under the General Permitted Development Order, property owners can convert a single-family dwelling (Use Class C3) into a small HMO (Use Class C4) without needing planning permission. However, an Article 4 Direction removes this permitted development right, requiring landlords to obtain planning permission before making such conversions.
Existing HMOs: If you own a property that was operating as an HMO before March 1, 2016, you should complete the Councilās declaration form to confirm its status. These properties will not require retrospective planning permission.
New HMOs: For properties intended to be converted into HMOs after March 1, 2016, landlords must apply for planning permission. The application process involves a one-time fee of Ā£385. Itās important to note that properties with more than five bedrooms or over two stories will still require an HMO licence, which must be renewed every five years.
The introduction of the Article 4 Direction aims to manage the distribution of HMOs across Lincoln, addressing concerns about community balance and housing quality. For landlords, this change means more oversight and potential limitations on property conversions. However, it also brings clarity to the planning process and helps maintain the cityās housing standards.
